1. Acceptance of Orders
By placing an order with Cake My Fancy, you agree to these Terms & Conditions. Orders are confirmed only once the required deposit or full payment has been received and acknowledged.

2. Deposits and Payments
• A non-refundable deposit of 50% of the total order value is required to secure your booking and event date.
• No order will be confirmed until the deposit has been received.
• The remaining 50% balance must be paid in full no later than 14 days (two weeks) before the event date.
• For orders placed within 14 days of the event date, full payment will be required at the time of booking.
• Failure to pay the remaining balance by the due date may result in cancellation of the order. In such circumstances, any deposit paid will remain non-refundable.
• Payments can be made via approved payment methods as advised at the time of booking.

3. Design and Customisation
• All cakes and baked goods are handmade and may vary slightly from photographs, sketches, inspiration images, or previous creations.
• While every effort will be made to match colours, designs, and decorations, exact replication cannot be guaranteed.
• Any changes to the agreed design must be requested before the quote is accepted and the deposit is paid. Additional changes requested after this point may be subject to additional charges and may not always be possible.
• Inspiration images are used as a guide only and will not be copied exactly.
• Please note that AI-generated images cannot be replicated exactly, as they often contain unrealistic proportions, structures, colours, textures, or decorative elements that are not achievable in real-life cake decorating. Where AI-generated images are provided as inspiration, we will create a cake that captures the overall style and theme while ensuring the design is practical, safe, and achievable.
• We reserve the right to make minor design adjustments where necessary to ensure the quality, structural integrity, and stability of the finished product.

4. Cancellations and Refunds
• The 50% booking deposit is non-refundable and non-transferable.
• No refunds will be issued for cancellations made within 14 days of the event date, as preparation and ordering of materials may already have commenced.
• Refunds will not be provided once products have been collected, delivered, and accepted by the customer.

5. Collection and Delivery
• Customers are responsible for inspecting their order upon collection or delivery.
• Once the order has been collected, responsibility for the product transfers to the customer.
• Delivery times are estimates and may be affected by circumstances beyond our control.
• Delivery charges will apply depending on location.
• We cannot be held responsible for damage occurring after collection or successful delivery.

6. Allergens and Dietary Requirements
• Our kitchen handles common allergens, including but not limited to milk, eggs, wheat (gluten), soy, peanuts, tree nuts, and sesame.
• While reasonable precautions are taken, we cannot guarantee that any product is completely free from traces of allergens.
• Customers must inform us of any allergies, intolerances, or dietary requirements at the time of ordering.
• It remains the customer's responsibility to ensure that products are suitable for all intended consumers.
• Where products are supplied for events, the allergen information provided must remain available to guests and consumers.

7. Storage and Consumption
• Cakes and baked goods should be stored according to the instructions provided.
• We are not responsible for damage or deterioration caused by incorrect storage, handling, transportation, or environmental conditions after collection or delivery.
• Products are best consumed within the recommended timeframe provided at collection or delivery.

8. Non-Edible Decorations
• Some cakes may contain non-edible decorations or support structures, including dowels, wires, ribbons, toppers, and other decorative items.
• These items must be removed before consumption.
• We accept no responsibility for injury or damage resulting from the failure to remove non-edible components.
• Non-edible decorations or supports will be highlighted upon collection or delivery and will not be included on allergen labels.

9. Photography and Marketing
• We reserve the right to photograph our products and workshops and use these images on our website, social media platforms, and other promotional materials.
• Customer personal information will never be shared without permission.
• If you do not wish for yourself or your child to appear in photographs taken during a workshop, please notify us before the event begins.

10. Limitation of Liability
• Our liability is limited to the value of the order purchased.
• We shall not be liable for any indirect, consequential, or incidental loss arising from the use, transportation, storage, or consumption of our products.

11. Professional Standards, Qualifications & Insurance
At Cake My Fancy, we are committed to maintaining high standards of food safety, professionalism, and customer care.
• We hold a valid Enhanced Disclosure and Barring Service (DBS) certificate.
• We maintain Public Liability Insurance for the protection of our customers and business operations.
• We hold Level 1 and Level 2 Food Hygiene and Food Safety Certificates.
• We have been awarded a current 5-Star Food Hygiene Rating by the Environmental Health Officer under the Food Hygiene Rating Scheme.
• All products are prepared and handled in accordance with current food hygiene and food safety regulations.
• We follow best practices for food preparation, storage, and allergen management.
• Copies of relevant certificates, food hygiene ratings, and insurance documentation are available upon reasonable request.

12. Adult & Children's Workshops
• A booking is only confirmed once the required deposit or full payment has been received.
• Workshop places are allocated on a first-come, first-served basis.
• Full payment must be received prior to the workshop date unless otherwise agreed in writing.

Children's Workshops
• Children attending workshops remain the responsibility of their parent, guardian, or accompanying responsible adult unless the workshop is expressly advertised as a supervised drop-off session.
• Parents or guardians must provide any relevant medical, allergy, behavioural, or additional support information before the workshop begins.
• We reserve the right to refuse participation if information affecting the safety or wellbeing of participants has not been disclosed.
• For added reassurance when working with children, we hold a valid Enhanced DBS certificate and maintain appropriate Public Liability Insurance.

Adult Workshops
• Participants are expected to behave respectfully towards instructors, staff, venue property, and fellow attendees.
• Any participant whose behaviour is deemed unsafe, disruptive, or inappropriate may be asked to leave the workshop without refund.
Allergies and Dietary Requirements for Workshops
• Workshop participants must disclose any allergies, intolerances, or dietary requirements at the time of booking.
• While reasonable precautions are taken, workshops are conducted in environments where common allergens may be present, and we cannot guarantee an allergen-free environment.

Illness and Attendance
• To help protect the health and wellbeing of all participants, attendees must not attend a workshop if they are experiencing symptoms of a contagious illness.
• If a participant develops sickness, diarrhoea, a fever, or any other contagious illness within 48 hours before the workshop, they must notify us as soon as possible and should not attend.
• Participants should remain symptom-free for at least 48 hours before attending a workshop following any episode of sickness or diarrhoea.
• We reserve the right to refuse entry to any participant who appears unwell on arrival if we believe their attendance may pose a risk to others.
• Where possible, we will endeavour to offer an alternative workshop date or transfer the booking; however, this will be at our discretion and subject to availability.
• No refunds will be issued for non-attendance due to illness unless otherwise agreed.

Health and Safety
• Participants must follow all instructions provided during the workshop.
• We reserve the right to remove any participant whose actions may place themselves or others at risk.
• Appropriate care will be taken at all times; however, participation is at the attendee's own risk.

Workshop Cancellations
• Deposits and payments for workshops are non-refundable unless the workshop is cancelled by us.
• If we need to cancel a workshop due to unforeseen circumstances, participants will be offered either a full refund or an alternative date where possible.
• We reserve the right to make reasonable changes to workshop content, venue, timings, or instructors if necessary.
